Terms and Conditions

If you do not understand these terms and conditions please do not place your order via this site but attend a Spexstudio Roadshow. This document sets out the Terms & Conditions of our supply to you the purchaser of products ordered through the Specstudio web site. Please read them carefully before you place your order as all accepted orders are bound by these Terms and Conditions.

General

1 These Terms and Conditions do not remove or affect your statutory rights at law. No binding contract exists between you the customer and Spexstudio.co.uk until your order has been accepted and confirmed. By ticking the box confirming your order to prooceed, it is deemed that you have read our terms and conditions.

2 As you are placing your order via the Spexstudio.co.uk website you are entitled by law to a 7-Day 'cooling off' period however cancellation of orders of prescription eyewear is not possible or acceptable after we have started manufacturing your glasses to your personal prescription which is normally within 24 hours of recieving your order.

3 All products and goods are sold subject to availability and for delivery within 28 days of the order being received.

4 These terms and conditions are our trading terms and conditions and cannot be altered or varied by any member of staff unless you the customer receive that variation in writing from Spexstudio.co.uk.

5 Nothing in these Terms excludes or limits our liability for death or personal injury resulting from our negligence or any breach of the statutory implied terms as to title of goods or for fraud or any other liability which by law we are not permitted to limit or exclude. Our maximum liability (and that of our employees, agents and subcontractors) to you in connection with any physical damage caused to your property through the negligence of us (or our employees, agents and subcontractors) will not in any circumstances exceed £1,000. In all other cases, our total liability (including our employees, agents and subcontractors) whether in contract, tort (including negligence) and breach of statutory duty or otherwise will not exceed the price of the goods and services to which the claim relates. In no circumstances will we (or our employees, agents or subcontractors) be liable to you for any business interruption, loss of use, loss of data, loss of profits, contracts, goodwill or anticipated savings.

6 We undertake that Spexstudio.co.uk Directors and employees, shall, at all times, comply with the provisions of the Data Protection Act 1998 in relation to data received from all customers or enquiries received and shall only process personal data received from you where necessary to fulfil contractual obligations or to contact you with products and services directly related to Spextsudio.

7 All communications between Spexstudio.co.uk and its customers will only be recognised if in writing and must be sent by first class post, Facsimile or email. (With confirmation received) Any written communication will be treated as having been served on the person receiving it 4 working days after posting (if sent by first class post) or at the time of transmission (if sent by facsimile and a satisfactory transmission report is obtained) or at the time and date stamp if received by email and confirmation of receipt is received by the sending party.

8 Any contract entered into via the Spexstudio.co.uk site is considered personal and applicable to the requesting customer as such it is not to be considered as transferable.

9 Spexstudio.co.uk undertakes to use best endeavour to fulfil its contractual obligations within the specified time agreed, but cannot be held responsible for third party circumstances outside its control.

10 'Next Day Delivery' refers to the day after goods are received at our UK offices and distribution centre. There may be a time delay of 3/4 days to allow for delivery into the UK when goods are produced in our non regular lab. Spexstudio.co.uk reserve the right to reassign or transfer the benefit of, or this contract in its entirety to another supplier or interested third party.

11 Spexstudio.co.uk reserve the right to review and amend these terms and conditions as and when circumstances dictate.

12 We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Once payment has been received by us we will confirm that your order has been accepted by sending an email to you at the email address you provide in your order form. Our acceptance of your order brings into existence a legally binding contract between us.

13 You must be over the age of 16 to order from Spexstudio.co.uk, and you must not be registered blind, or partially sighted, or ordering on behalf of someone under 16 years of age. If you breach this condition there could be serious detrimental consequences to your eyes.

14 You must provide us with details of the relevant valid prescription that is to be applied to the goods at the time you make your order.

15 You must provide us with prescriptions given to you by a registered Medical Practitioner or OMP or registered Optometrist or Ophthalmic Optician following a testing of sight by him or her within the last two years or as advised by your eyecare practitioner. We shall rely upon the prescription that you provide to us and the goods shall contain lenses matching the prescription that you submit to us.

16 If you are unsure of the relevant prescription to be applied to the goods, you must consult a registered medical practitioner or registered ophthalmic optician or optometrist before placing an order.

17 You are responsible for providing us with accurate prescription details. We shall not be liable for any loss or damage that you may suffer as a result of you providing us with inaccurate prescription details unless such loss or damage is caused by our negligence.

18 Unless you state otherwise, we use an appropriate average pupillary distance 'PD' to complete your order based on calculations and the frames we provide and you chose and your prescrtpion details. The exact PD measurement can be provided by a qualified Ophthalmic Optician, Dispensing Optician or Optometrist and may be charged for. By agreeing to our terms and conditions, and unless you state otherwise when making your order, you hereby instruct us use an average PD of 63mm for bifocal and single vision distance lenses, or a PD of 60mm for single vision reading lenses. Spexstudio.co.uk recommends that you consult your optician to obtain your PD before ordering, and provide that number to us when ordering.

19 We will not fulfil orders for lenses of over 10 dioptres without contacting us first. You must not place an order of this kind. We will not fulfil orders for lenses where the sphere value added to the cylindrical value is greater than 12 dioptres. You must not attempt to place an order of this kind, without contacting us first. We will not fulfil orders for varifocal or progressive lenses unless you have been seen by one of our dipensers at our roadshow.

20 You must not resell or attempt to resell the goods that we sell you.

21 Prices and charges at our Road Shows and catalogue may vary slightly from time to time from prices on our website.
